Having a driver’s license is a privilege, and disobeying the rules of the road will result in potentially having your license suspended or revoked. If you are facing a license suspension or revocation, you are granted an administrative DMV hearing to determine if you keep your license or not. You must follow Nevada DMV reinstatement procedures and physically receive a license to regain your driver’s license. If you got your license suspended or revoked in another state, you are not allowed to be issued another license in a different state until the suspension or revocation is up.
Types of Suspensions and Revocations
There are certain circumstances in which a driver will either have their license suspended or revoked.
- Receiving a DUI
- Point suspension (accumulating 12 or more demerit points within a year)
- Collision with pedestrian or bicyclist
- Not maintaining auto insurance
- Not paying child support
- Failure to appear in court
- If an accident occurs and damages are worth more than $750 and you do not have liability insurance
- Street racing
- Graffiti
- If a juvenile is found guilty of buying or possessing drugs or alcohol
Suspension and Revocation Length
The two most common ways drivers have their license suspended or revoked is either a DUI, or accumulating twelve or more demerit points within a year. Your driving privileges will remain revoked or suspended indefinitely until you comply with all the requirements to reinstate your license. After your first DUI offense, your license will be revoked for 185 days, but you may be eligible to apply for a restricted license after 90 days. If you receive a second DUI within seven years, your license will be revoked for one year with no eligibility to apply for a restricted license. If you accumulate twelve or more demerit points within a year, you will face at least a six-month suspension on your license. If you do not have car insurance, you will have your license revoked until you can prove liability insurance. The court will decide the length of suspension or revocation in other offenses.
Reinstating your Driver’s License
There is no time limit for reinstating your driver’s license, although there are requirements you have to meet. Depending on the driver and the length of the suspension or revocation, you may have to take a vision test, written test, or driving skills test. If your license has been suspended or revoked for a year or more, you will have to pass a driving skills test to regain your license. If your license was suspended or revoked due to a DUI, you will have to get an ignition interlock device installed into your vehicle. It is the responsibility of the driver to pursue getting their license back by contacting the DMV and filling out the proper paperwork. If you got your license suspended or revoked due to criminal charges and they were dismissed, you still are required to go through the reinstatement process. Driving on a suspended or revoked license is considered a misdemeanor in Nevada. You could receive up to six months in jail and/or up to $1,000 in fines.
Can You Fight a License Suspension or Revocation?
The defendant has up to seven days from the notice to contest a suspension or revocation. Depending on the outcome of the hearing, you may be able to continue driving. A DMV administrative hearing is similar to a standard trial, although it is on a much smaller scale. Typically, DMV hearings are difficult to overcome and harder to win than standard trials. If the defendant does win the DMV hearing, they will be able to keep their driver’s license and continue driving. If the state wins, then the defendant will be informed by the DMV about the length of the suspension or revocation.
