As reported on this blog in February 2017, the Nevada Legislature has passed NV SB259, which would impose mandatory Ignition Interlock System (IIS) installation for all DUI convictions in Nevada, including first-time convictions. The bill was sent to Governor Sandoval’s office for signature or veto on June 8, 2017. The bill was approved by the governor on June 12, and will now become law.
Reaction to Passage of SB 259
Until now, the court has had the discretion to order IIS installation for non-felony first-time DUI offenders, but NV SB259 requires all Nevada courts to require IIS installation for 90 days after a non-felony first-time DUI arrest. Nevada would become the 30th state to adopt a law requiring IIS installation for first-time DUIs.

This bill requires anyone arrested with a Blood Alcohol Concentration (BAC) of greater than .08 to use an IIS device for 90 days after arrest as a condition of continued driving. If convicted, the bill requires the courts to order the use of an IIS for six months. Credit will be given for time used if a driver installs such a device prior to conviction.
