I read an interesting article on 8newsnow.com. They were at traffic court, following the cases of about 173 motorists were in court that day for various violations. The citations were everything from speeding, to jaywalking, to driving without a license, a pretty typical day in court. The people stepped up, one by one in front of judge Chuck Paine, a retired former deputy.
The judge was sympathetic, with the economy the way it is, and with how dangerous this year has been, he is more worried about the safety of individuals than making them pay fines. All 55 individuals with speeding tickets were fined, but first time offenders had their tickets knocked down to parking tickets so that no points were taken from their record. The 10 individuals who were cited for jaywalking, 5 of them were lucky enough to walk out without fines, but they still received lectures on the dangers of jaywalking, especially with the climbing death toll this year.
By county ordinance, Paine said a speeding ticket for a first-time offender can be as high as $500. But he said the Justice Court has adopted a schedule with much lower fines. Going one to 10 miles an hour over the speed limit is a $145 fine, but it’s $195 for driving 11 to 20 mph over the limit, $215 for 21 to 30 mph over the limit and $305 for 31 to 40 mph over the limit. Jaywalking fines are $95.
Paine agreed in some cases to reduce the minimum monthly fine payments for those who said they couldn’t afford the county’s standard payment plan of at least $100 a month. And there were also many instances where an individual with multiple offenses had some of those violations dismissed. This was particularly true in cases involving failure to wear a seatbelt or in instances where a moving violation was combined with another offense, such as a license issue that the motorist has since rectified.
